This Privacy Policy describes how we gather information from you as a Visitor or Subscriber on our Site, and how we may use and share that information. By visiting the Site, you are accepting the practices described in this Privacy Policy. All defined terms shall have the meaning set forth in the Terms of Use.

Personally Non-Identifiable Information

We may automatically collect personally non-identifiable information from Visitors and Subscribers to the Site, such as network locations, IP addresses, and the sections of the Site you visit.

The Site may use “cookie” technology to help us collect other personally non-identifiable information, to enhance your experience using the Site, and to serve advertisements or other information that may be of particular interest to you. We do not link the information we store in cookies to any personally identifiable information. Cookies are small packets of data that a web site stores on your computer’s hard drive so that your computer will “remember” information about your visit. We may use both session and persistent cookies. A session cookie expires when you close your browser; a persistent cookie remains on your hard drive for an expended period of time. If you reject cookies, you may still visit the Site, but may not be eligible to use some areas of the Site and/or the Services (as defined hereinafter). We may allow third-party companies to set and access their own cookies. Such third-party cookies are not governed by this Privacy Policy, but by the privacy policy of such third party.

The Site may also use “clear gif” technology, commonly known as web beacons, to help us manage Content on the Site by tracking what Content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web site users. Unlike cookies, which can be stored on a user’s computer hard drive, clear gifs are embedded invisibly on web pages and are about the size of the period at the end of this sentence.

Personally Identifiable Information

If you choose to register on the Site as a Subscriber we (or our designated third party service providers) will collect your name, email address and password from you. If you choose to upload Musical Content for the sale on the Site and enter into the Artist Agreement, then, in addition to your name, email address and password we (or our designated third party service providers) will also collect your mailing address, credit card information, bank account information, billing address and other information from you. If you choose to purchase Musical Content, we (or our designated third party service providers) will collect credit card information from you (collectively, “Personal Data”). We do not collect Personal Data from Visitors.

How We Use Your Information

We may use your Personal Data in a manner that is consistent with this Privacy Policy. If you provide Personal Data for a certain reason, we may use such Personal Data in connection with the reason for which it was provided. For instance, we will use Personal Data to administer access to the Site and the Services; to permit our third party service providers to conduct credit checks; to provide the Services and respond to other inquires; provide you with additional information about our products and services; and permit third parties to use Personal Data to provide you with information about their products or services. You have the right to correct or modify your Personal Data by providing notice to us. (see “How to Contact Us”).

We may also use your Personal Data and personally non-identifiable information collected through the Site to help us improve the functionality of the Site, to better understand the Visitors and Subscribers of the Site, to provide and improve our Services and to serve targeted advertisements.

Agents, Consultants and Related Third Parties:

We, like many businesses, sometimes hire other companies to perform certain business-related functions. Examples include mailing information, maintaining databases, processing payments and running credit and background checks. When we employ another company to perform a function of this nature, we only provide them with the information that they need to perform their specific function.

Legal Requirements:

We may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (a) comply with a legal obligation, (b) protect and defend our rights or property, (c) act in urgent circumstances to protect the personal safety of users of the Site or the public, or (d) protect against legal liability.

Business Transfers:

As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Data may be part of the transferred assets.

Aggregated Personal Data

We may analyze your Personal Data in aggregate form which does not identify you personally. We may share this aggregate data with our affiliates, agents, advertisers, manufacturers and business partners. Your Choices

You can always choose not to provide your Personal Data to us, but that may mean you are not able to use certain Services offered via the Site.

Children

We do not knowingly collect Personal Data from children under the age of 13 through the Site. If you are under 13, please do not give us any Personal Data. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children to never provide Personal Data on any web site without their permission. If you have reason to believe that a child under the age of 13 has provided Personal Data to us through the Site, please contact us, and we will endeavor to delete that information from our databases.

Security

We have reasonable security measures in place intended to protect against the loss, misuse or alteration of Personal Data. However, we are unable to guarantee that the security measures we take will not be penetrated or compromised or that your Personal Data will remain secure under all circumstances.


Third Party Web Sites.


The Site may contain links to third-party web sites. We have no control over the privacy practices or the content of any of our business affiliates, advertisers, sponsors, or other web sites to which we provide links from our site. As such, we are not responsible for the content or the privacy policies of web sites to which our site may link. We encourage you to review the privacy policies of any web site sponsors when visiting other web sites.

Changes to Our Privacy Policy. This Privacy Policy is effective as of the “Last Updated” date set forth above. We reserve the right to amend this Privacy Policy at any time and from time to time without notice. If you use the Site after a revised Privacy Policy has been posted, you will be deemed to have agreed to such Privacy Policy. All defined terms herein shall have the meanings assigned in the Terms of Use.
